That Pesky EU Cookie Law (May 2012)
Much has been made of the upper limit of the fine that can be imposed for violation of this law so it's important that this is put into perspective. The following is taken from the ICO website. It's an extract from an interview with Dave Evans, Group Manager, Information Commissioner's Office.
Question:
What approach will the ICO be adopting to enforce the amended cookie laws?
Answer:
"...it is important to know that monetary penalties can only be issued by this office in cases where there's been a serious breach that's likely to cause substantial damage to people, and where there is kind of a willful element towards non-compliance. Now it is difficult to imagine that non-compliance with the cookies rule is ever going to trigger a situation in which we would be able to issue a monetary penalty."
